Trademark Registration Process in India
Trademark Search
Before applying, a comprehensive trademark search is conducted on the official IP India portal to check if the desired brand name, logo, or mark is already registered or has a close resemblance. This step helps in avoiding conflicts, legal disputes, and future objections.Application Filing (Form TM-A)
After ensuring availability, the next step is filing the trademark application either online or offline using Form TM-A. The application must include details such as the logo/wordmark, applicant’s name, trademark class, business description, and the date of first usage (if applicable).Application Allotment
Once the application is filed successfully, a filing number is generated. From this stage, the applicant is legally allowed to use the ™ symbol with the brand name, indicating that the trademark registration process is underway.Examination by Registrar
The application is then examined by a Trademark Registrar/Examiner. The examiner verifies compliance with the law and checks for conflicts with existing marks. The examiner may either accept the application or raise an objection.Objection (if any)
If objections are raised, the applicant must submit a reply within 30 days, clarifying the uniqueness of the mark. In certain cases, hearings may be scheduled to defend the application. A well-prepared response increases the chances of approval.Opposition (if any)
After examination, the trademark is published in the Trademark Journal. During this stage, any third party can oppose the registration within 90 days if they believe the mark infringes on their rights.
